(BUFFALO, NY) WKBW – Some private companies require their customers to provide proof of vaccination, while others operate on the honor system.
“We have decided to take responsibility and only allow people here at Club Marcella who are vaccinated,” said Club Marcella owner Joe Marcella.
Marcella said the policy only lasted a month.
“I had to give up, Chippewa was busy, Allentown was busy and I was only a quarter full,” said Marcella.
In New York City, proof of vaccination is now required for indoor dining and gyms. A bar in Rochester decided to follow suit.
“I want people to really get to this place knowing it’s as safe as we can possibly get,” said Karrie Laughton, owner of Lux Bar in Rochester.
Misuta Chow’s on Main Street will not turn away people who fail to provide proof of vaccination. However, they will require customers to wear a mask if they don’t.
“And that is absolutely legal under current law,” said legal analyst Florina Altshiler.
Misuta Chow says they consider it irresponsible to adhere to the honor system. Altshiler said this was not a violation of HIPAA or anyone’s rights.
“They say you can’t enter their facility if you aren’t vaccinated, they don’t tell you to get the vaccine,” Altshiler said.
Marcella said he doesn’t plan on reintroducing his vaccine needs unless he can be sure it won’t cost him business.
“It gave us so many problems and headaches,” said Marcella. “Everyone does it or nobody does it, that’s it, very simple.”
A dozen other local bars and breweries said they don’t currently require proof of vaccination, about half said they operate on the honor system, but some said this could change.
